Eligibility

You represent and warrant that you have the legal right, power, and authority to agree to these Terms, enter into a binding contract, and perform your obligations under it.

Definitions

Payment Instrument: Includes credit card, debit card, bank account, prepaid payment instrument, UPI, IMPS, or other payment methods made available by financial institutions from time to time.

Platform: The website/platform where the Merchant offers products or services and where transactions may be initiated.

Transaction: The order/request placed by the User to purchase products and/or services listed on the Platform by paying the Transaction Amount.

Transaction Amount: The amount paid by the User in connection with a Transaction.

User: Any person availing the products and/or services offered on the Platform.

Website: Refers to www.instamojo.com or the mobile application, where applicable to payment flow.

Merchant's Rights

You agree that we may collect, store, and share information provided by you for delivering products/services availed on our platform and for contacting you in relation to the same.

Your Responsibilities

You agree to provide true, complete, and up-to-date information required to complete transactions, including personal details (such as name, email, phone number, delivery address, age, gender, or other required details) and accurate payment information.

Prohibited Actions

You may not use the Platform for any purpose other than the intended use. You agree not to:

• Retrieve data/content systematically to create compilations/databases without written permission.
• Use the platform in unauthorized ways, including collecting user information for unsolicited communication.
• Circumvent or interfere with security features or usage restrictions.
• Trick, defraud, or mislead us/users, including attempts to obtain sensitive account data.
• Submit false abuse reports or misuse support channels.
• Use automated tools/scripts for extraction, messaging, or misuse.
• Disrupt or burden platform infrastructure/services.
• Impersonate users/persons or misuse usernames.
• Harass, abuse, or harm any person using information obtained from the platform.
• Compete unfairly or use platform content for unauthorized commercial gain.
• Reverse engineer, decompile, disassemble platform software.
• Bypass access-control measures.
• Harass or threaten employees/agents.
• Copy/adapt platform software (including PHP/HTML/JavaScript or other code) without permission.
• Upload malicious material (viruses/Trojans/spam/repetitive disruptive content).
• Disparage or tarnish the platform/merchant.
• Use the platform contrary to applicable law.

Limitation of Liability

In case of defective product/service deficiency or mismatch with description, your recourse is to initiate a refund process as per applicable refund terms. We expressly disclaim liability for losses beyond this framework.

You agree to indemnify and hold harmless the Merchant, affiliates, agents, and representatives against claims, liabilities, damages, costs, and expenses arising from breach/alleged breach of these Terms by you.

Guidelines for Reviews

If review/rating functionality is provided, you must ensure reviews are lawful, factual, and respectful. Reviews must not include hate speech, abusive language, discriminatory references, illegal content, or false/misleading statements. We may accept/reject/remove reviews at our sole discretion.

By posting a review, you grant us a perpetual, non-exclusive, worldwide, royalty-free, assignable, sublicensable right to use, reproduce, modify, translate, transmit, display, perform, and distribute review content.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to arbitration provisions below.

Any dispute arising out of these Terms shall be referred to arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996. Parties shall mutually appoint a sole arbitrator within 30 days of dispute notice, failing which appointment shall proceed as per law. Proceedings shall be in English. Arbitration shall be confidential. The arbitral decision shall be final and binding. Parties may seek suitable injunctive relief from courts in Bengaluru where appropriate.

Grievance Redressal

For product/service and transaction-related issues (including double debit, fraudulent/unauthorized transaction, refund requests), please contact us through the support/contact channels available on the platform.

Disclaimer

• By initiating a transaction, you enter into a legally binding contract to purchase the listed product/service.
• You must use legitimate and lawful funds through accepted payment instruments.
• Payment details may be shared with relevant third parties for fraud verification or legal compliance.
• We disclaim liability arising from unauthorized use of your payment instrument.
• Payments are made at your own risk and volition; we are not liable for losses due to authorization failures, malfunctions, errors, or unscrupulous activities.
• You must keep credentials/order identifiers confidential.
• Platform content is for general information and does not constitute advice.
• External links are for information only and do not imply endorsement.
• User-generated content may not be verified by us and does not represent our views.
• We do not guarantee the platform is free from bugs/viruses; users should use adequate protection.
